TERMS OF SERVICE
These Terms of Service (“Terms”) govern your use of the website kustomlifeco.com and any products, quotes, orders, or services provided by Kustom Life Co (“Kustom Life Co,” “KLC,” “we,” “us,” or “our”). By using our website, requesting a quote, placing an order, or accepting a proof or estimate, you (“you,” “Client,” or “Customer”) agree to these Terms.

1. Our Services
Kustom Life Co provides custom apparel and branding services, which may include screen printing, embroidery, cut and sew garments, neck tagging, hang tags, graphic design and logo development, promotional products, trade show and event materials, uniforms, e-commerce website design and development, and digital marketing services. The specific scope, quantities, specifications, and pricing for your project are set out in the written quote, estimate, work order, or invoice we provide to you (each, an “Order”).
2. Eligibility
You must be at least 18 years old and have the legal authority to enter into a binding agreement, on your own behalf or on behalf of the business you represent, to place an order with us.
3. Quotes, Orders, and Acceptance
- Quotes and estimates are valid for [30] days unless stated otherwise, and are based on the specifications, quantities, artwork, and deadlines you provide.
- Changes to quantity, garment selection, ink or thread colors, artwork, print locations, or deadlines after a quote is issued may change pricing and turnaround time and require a revised quote.
- An Order becomes binding when you approve the quote, estimate, or invoice in writing (including by email or text) and, where applicable, pay the required deposit.
- We reserve the right to decline or cancel any Order, including for artwork we cannot legally reproduce, out-of-stock goods, pricing errors, or non-payment.
4. Artwork, Files, and Intellectual Property
Your artwork
You retain ownership of the logos, artwork, trademarks, and content you supply to us. By submitting artwork you represent and warrant that you own it or have all rights and licenses necessary to reproduce it on the goods you have ordered, and that its use does not infringe any copyright, trademark, right of publicity, or other right of any third party.
You agree to indemnify, defend, and hold Kustom Life Co harmless from any claim, demand, loss, damage, or expense (including reasonable attorneys’ fees) arising from artwork or content you supply. We may refuse any Order involving artwork we believe may infringe third-party rights or that we consider unlawful, hateful, or otherwise objectionable, at our sole discretion.
Our work product
Designs, artwork, mockups, separations, digitized embroidery files, screens, dies, and other production assets created by Kustom Life Co remain our property unless a written agreement transfers ownership to you. Complimentary or included design work grants you a license to use the resulting design for the products ordered; ownership transfer or release of source files may be available for an additional fee.
Portfolio and promotional use
Unless you tell us otherwise in writing, you grant us a non-exclusive right to photograph and display finished work produced for you in our portfolio, website, social media, and marketing materials. You may withdraw this permission at any time by contacting us.
5. Proofs and Approvals
We provide a digital proof or mockup for your written approval before production begins. It is your responsibility to review the proof carefully, including spelling, artwork placement, sizes, quantities, colors, and any names or numbers. Once you approve a proof, you accept responsibility for its contents, and production errors that match the approved proof are not eligible for reprint, refund, or credit. Production timelines begin from the date of proof approval and receipt of any required deposit, not the date of the original request.
6. Pricing, Deposits, and Payment
- Prices are quoted in U.S. dollars and exclude applicable sales tax, shipping, and rush fees unless stated otherwise.
- A deposit of [50%] may be required before production begins. Remaining balances are due [upon completion / prior to shipment or pickup / per invoice terms].
- Accepted payment methods are listed on your invoice. Payments are processed by third-party payment processors.
- Past-due balances may accrue a late fee of [1.5%] per month or the maximum permitted by law, and we may suspend production or withhold delivery until the account is current.
- Goods remain the property of Kustom Life Co until paid in full.
- Returned payments and chargebacks may incur a fee of [$35].
7. Production, Turnaround, and Delays
Estimated turnaround times are provided in good faith and are not guaranteed unless we agree in writing to a firm in-hands date. Turnaround begins after proof approval and deposit. We are not responsible for delays caused by circumstances beyond our reasonable control, including supplier or blank-garment shortages, carrier delays, weather, equipment failure, labor disruption, or acts of God. If a delay is caused by us and you have a written guaranteed in-hands date, your remedy is limited as described in Section 18.
8. Manufacturing Variances
Custom decoration is a manual and semi-automated process. By placing an Order you accept the following industry-standard variances:
- Under-run / spoilage. We reserve the right to deliver up to [3%] fewer pieces than ordered due to garment defects or misprints; you will be billed only for pieces delivered. If exact quantities are required, please order additional pieces.
- Color matching. Screen and monitor colors do not match printed inks, threads, or dyes exactly. Exact PMS matching may be available for an additional charge and must be requested in writing.
- Placement tolerance. Print and stitch placement may vary by up to [1 inch] due to garment size, cut, and manual loading.
- Blank garments. Garment sizing, dye lots, and availability are controlled by our suppliers and may vary between production runs.
9. Customer-Supplied Goods
If you supply your own garments or items for decoration, you do so at your own risk. We are not responsible for defects in customer-supplied goods, garments damaged or spoiled during production, or shortages. We recommend supplying at least [5%] extra. We do not reimburse the cost of customer-supplied goods, and our liability for such items is limited to the decoration charges paid for the affected pieces.
10. Shipping, Pickup, and Risk of Loss
Shipping charges are the responsibility of the Customer unless stated otherwise. Title and risk of loss pass to you upon delivery to the carrier or upon pickup. We are not responsible for carrier delays, loss, or damage in transit; claims for shipping damage must be filed with the carrier. Orders not picked up within [30] days of notification may incur storage fees.
11. Cancellations, Returns, and Claims
- Custom products are made to order and are not eligible for return, exchange, or refund except where the goods are defective or do not conform to the approved proof.
- Orders cancelled after production has begun are subject to charges for materials, garments, labor, and design work already incurred. Deposits may be non-refundable once production has started.
- Claims for defects, shortages, or non-conforming goods must be submitted in writing within [7] days of receipt, with photographs and the affected pieces retained for inspection.
- Where a claim is valid, our remedy, at our option, is to reprint or replace the affected pieces or issue a credit or refund for them. We are not responsible for garments that have been worn, washed, altered, or re-decorated.
12. SMS / Text Messaging Terms

20. Governing Law and Disputes
